
Actor Alec Baldwin is petitioning to have a lawsuit by family members of the “Rust” cinematographer who was murdered on set in 2021 dropped, calling it “misguided.”
Baldwin said in a court filing Thursday in California Superior Court for Los Angeles County that Deadline obtained that a settlement it reached with Matthew Hutchins, the husband of the late Halyna Hutchins, in October 2022 should have been the end of the affair.
Hutchins was murdered in October 2021 after Baldwin apparently fired a prop gun containing an actual round at her while she was rehearsing a scene from the film.
His mother, father and sister filed suit in February on charges of assault, intentional infliction of emotional distress, neglect and loss of consortium.
Family members seek compensation based on the damage to relationships. But Baldwin argues in her most recent introduction that Hutchins’ family members had not been closely associated with her for many years.
“The loss of a daughter and a sister is undoubtedly painful in any circumstance,” the presentation reads. “However, Plaintiffs, who had been physically, financially, and emotionally estranged from Halyna for years prior to her death, have no viable cause of action against Defendants.”
It also stated that the three plaintiffs are Ukrainian citizens living in or near the capital of kyiv.
Baldwin argues that the lawsuit is “especially misguided” since the marriage is necessary for loss of consortium under California law, but Hutchins had no such relationship with any of the plaintiffs.
The suit names Baldwin, gunsmith Hannah Gutierrez-Reed, Rust Movie Productions and others involved in the production.
Baldwin’s filing comes about two months after prosecutors dropped the firearm enhancement from the manslaughter charges that were filed against Baldwin and Gutierrez-Reed. Santa Fe District Attorney Mary Carmack-Altwies charged the two with two counts of manslaughter each.
Baldwin has maintained that he had “no reason” to believe the gun contained live bullets.
The firearms enhancement charge would carry a mandatory five-year prison sentence if convicted, while manslaughter would only carry up to 18 months.
